Terms of Service

1. Who we are and what these terms cover

Color Grading Academy ("CGA") is operated by Colour Training Inc.("Colour Training," "we," "us," or "our"), 429 Lenox Ave, Unit 519, Miami Beach, FL 33139, United States. These Terms of Service ("Terms") apply to colorgradingacademy.com, our learning platform, live sessions, community spaces, and every course, subscription, project, and program we offer (together, the "Services").

By creating an account, making a purchase, or using the Services, you agree to these Terms, our Privacy Policy, and our Code of Conduct. If you do not agree, please do not use the Services.

2. Eligibility and accounts

• You must be at least 18 years old to use the Services.
• You are responsible for keeping your login details secure and for all activity on your account. Tell us promptly at students@colorgradingacademy.com if you suspect unauthorized use.
• Accounts are personal. You may not share your login, resell access, or let anyone else use your enrollment.
• Please give us accurate information when you register and keep it up to date.

3. What we offer

3.1 Free courses

Free courses are offered at no cost and without a payment method. We may change, update, or retire free content at any time.

3.2 Subscription

The subscription gives you access to our Beginner and Advanced course tracks for as long as your subscription is active. It renews automatically each billing period at the price shown at checkout until you cancel. You can cancel at any time from your account or by emailing students@colorgradingacademy.com; cancellation stops future renewals and your access continues until the end of the period you have paid for.

3.3 Projects

Projects are one-time purchases. Each project includes the materials described on its page, such as a session recording, camera footage, a reference project file, and a written critique of one submitted grade.

3.4 Master's Program

The Master's Program is available by application only. Acceptance is at our discretion and is not guaranteed. Enrollment is confirmed once you have been accepted and have paid in full or started the payment plan offered at the time of enrollment. Program structure, schedule, and curriculum are described on the Master's Program page and may be adjusted to improve the program.

4. Prices and payment

• Prices are shown in US dollars and are charged at the price displayed at checkout. Payments are processed by Stripe.
• For the Master's Program, you may pay in full or, where offered, by monthly installments. If you choose installments, you authorize us to charge each installment on its due date. If an installment fails and is not resolved within a reasonable time after we contact you, we may pause your access until payment is brought up to date.
• You are responsible for any taxes, currency conversion, or bank fees that apply to your purchase.
• We may change prices for future purchases or renewals. We will give subscribers reasonable advance notice of a price change, and it will not affect a period you have already paid for.

5. Refunds

• Subscription: you may request a full refund within 7 days of your purchase.
• Master's Program: full refund if you withdraw on or before the end of Week 4 of the program. If you withdraw after Week 4 and on or before the end of Week 12, you receive a pro-rated refund based on a monthly value of USD 300 (the USD 3,600 program fee divided by 12). If you are on the payment plan, all remaining installments are cancelled when you withdraw. No refunds are given after Week 12.
• Projects: within 48 hours of purchase.
• To request a refund, email students@colorgradingacademy.com from the address on your account. Approved refunds are returned to the original payment method.

6. Our content and your license to use it

All course videos, lessons, live session recordings, project materials, reference grades, LUTs, DCTLs, documents, and other materials we provide ("CGA Content") are owned by Colour Training Inc. or our licensors and are protected by copyright and other laws.

We give you a personal, non-exclusive, non-transferable license to access and use CGA Content for your own learning while your access is active. You may not copy, download (except where we provide a download), record, redistribute, sell, publicly show, or share CGA Content, or use it to build a competing course or training data set.

6.1 Project footage

Camera footage supplied with a project is licensed to you, not sold. You may use it to complete the project and may show your own finished grade in your personal reel and portfolio, with credit as described on the project page. You may not redistribute the original footage, use it in commercial work, or share it with others.

7. Your work

You keep ownership of the grades, assignments, theses, and other work you create ("Your Work"), subject to our rights in any CGA Content it includes. By submitting Your Work for review, you give us a worldwide, royalty-free license to view, copy, and display it for the purpose of assessing it, giving feedback, and teaching within the Services, including in live critique sessions and their recordings shared with enrolled students.

We will only feature Your Work publicly (for example, on our website, in our marketing, or in our academy library of theses) with your permission.

8. Live sessions and recordings

Live sessions run on Zoom and may be recorded and made available to enrolled students. We will tell you when a session is being recorded. If your work is reviewed or you speak during a recorded session, you agree to appear in that recording. Students may not record live sessions themselves.

9. Community spaces

Our community, including the Art of Color Discord, is governed by our Code of Conductas well as Discord's own terms. Content you post can be seen by other members. We may remove content or members that breach the Code of Conduct.

10. Software and tools

Some programs include access to third-party or Colourlab software (for example, ColourLab AI Pro, LookDesigner, GrainLab, and the FilmLab AI plugin suite for Master's students). That access lasts for the period stated for your program, is subject to the software's own license terms, and ends when the stated period ends.

11. AI tutor

Our AI chatbot tutor is a learning aid. Its answers are generated automatically and can be incomplete or wrong; they are not professional advice and do not replace feedback from our instructors. Please do not share sensitive personal information with it.

12. Certificates and outcomes

• Certificates, including the Master's Certificate, are issued when you meet the completion and assessment requirements of the course or program. Assessment decisions are made by our instructors.
• Color Grading Academy is not an accredited institution, and our certificates are not academic degrees.
• We work hard to prepare you for professional work, but we do not guarantee employment, income, clients, or any particular career outcome.

13. Suspension and termination

You may close your account at any time. We may suspend or end your access if you breach these Terms or the Code of Conduct, fail to pay, share your account, or misuse CGA Content. Where we end access because of a breach, refunds are handled under section 5 and applicable law.

14. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be uninterrupted or error-free.

15. Limitation of liability

To the fullest extent permitted by law, Colour Training Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Service in question in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law.

16. Governing law and disputes

These Terms are governed by the laws of the State of Florida, and disputes will be heard in the courts of Miami-Dade County. If you live in a country whose consumer laws give you rights that cannot be waived, those rights still apply.

17. Changes to these Terms

We may update these Terms from time to time. We will change the effective date above and, for material changes, notify registered users by email or on the Site before the change takes effect. Continuing to use the Services after that means you accept the updated Terms.
